Judy DeMers’ False Statement Dated April 20, 1990-Request For Emergency Leave

Date University first notified me of this charge: February 8, 1991
FACTS:
Because of the hostility and insanity exhibited by Judy DeMers, I mailed a request for an emergency leave of absence to her office in an effort to salvage my medical career. I did not meet with or speak to DeMers as alleged, however on April 20, 1990, Judy DeMers left a message on my answering machine stating the Dean denied my requested emergency leave of absence. I certainly did not converse with Gayle Ellner because she is the troublemaker who initiated the cheating allegations against me. Moreover, several law students (witnesses) attempted to provide statements to exonerate me but the Medical School refused to entertain their statements.
JUDY DEMERS’ LIE
4-20-90. Vivian wrote to me requesting an Emergency LOA. It was forwarded to the SPRC.
My 4-22-90 memo details the period 4-18 through 4-22-90.
I received a telephone call from Gayle Ellner at about ?11:30 p.m. on Thursday, 4-19-90. She stated Vivian had called her and was yelling that because of her she was suicidal, an alcoholic , and a drug addict. Gayle, in turn, called Joe Burns, another medical student who lives in the same residency hall (Hancock) as Vivian. Joe agreed to check on Vivian and asked Gayle to call me. I believed Vivian’s words, in part, reflected our discussion in relation to the Behavioral Assessment results; but, I checked it out, never-the-less. Joe had talked to the Head Resident, who in turn, notified University Police. Vivian returned to Hancock Hall later and was very angry about the report. She denied having called Gayle Ellner. On 4-20-90 (Friday), I spent a good part of the day talking with persons who were involved in the incident. They all just showed up at the office (Gayle Ellner, Joe Burns, Tom Murphy - Vivian’s boyfriend).
Vivian had called SHS for an appointment with Dr. Doan. She was informed no appointments were available. I called SHS , made the arrangements, and called Vivian back. She was seen that afternoon.
Vivian showed up at my office in the late afternoon after everyone had left. She was pacing, screaming at me, and frothing at the mouth. I told her twice to either calm down, leave, or I would call the Police. Her behavior continued and she started pounding at the table. I called the University Police, requesting assistance in removing her from my office. She continued another 3-4 minutes, leaving just before the Police arrived.
She wanted an emergency leave-of-absence. I told her I would not support the request, but I would relay it to the Dean. I did that about 7:00 p.m. when the Dean was available. He denied the request.
Vivian called me later that evening and apologized. She stated she "had lied to me"; she was "ready to get help"; and she would consider withdrawing from medical school.
Citing sovereign immunity, the University of North Dakota refuses to comply with regulations guaranteeing me the opportunity to respond to this factually incorrect allegation contrived to procure my dismissal!
EVIDENCE: If this incident actually transpired, the authorities would possess a record of the incident. The absence of records reveals this Gayle Ellner and Judy DeMers engineered this incident merely to cause additional turmoil.
Moreover, Chronological University records disclose I did not converse with Judy DeMers as indicated; I merely wrote a letter requesting an Emergency Leave of Absence.
