Judy DeMers Manipulated The University To Hold A Behavioral Assessment Based On A Conversation That Never Transpired

FACTS:

In addition to lying to the Court and the University, Judy DeMers conned the University into holding a behavioral assessment on false pretenses. Tape-recorded evidence reveals one University committee member expressed concern about my state of mind after I learned those people destroyed my career, my life and everything I worked to achieve.

Moreover, telephone records reveal I did not telephone Judy DeMers on April 15,1990. Nevertheless, based upon a telephone conversation that never occurred Judy DeMers initiated several steps to "make it look as if I were unstable." This would guarantee dismissal from medical school.

Telephone record presented below reveals I never telephoned Judy DeMers as alleged. I telephone my boyfriend, Thomas Murphy on April 10 and April 16, 1990, from Cheyenne, Wyoming.

April 17, 1990-Subsequent to Judy DeMers’ prevarication, the University attempted to appraise my behavior based on DeMers’ distortions of reality. However, I did not attend the behavioral assessment because the University failed to notify me of this meeting. Nevertheless, the meeting transpired.

QUESTION:

How can you assess an individual’s behavior who is not present?

JUDY DEMERS’ LIE

4-16-90. I took several steps based on my 4-15-90 telephone conversation with Vivian. I talked with the UNDSM associate Dean for Basic Sciences; I consulted with the UND Dean of Students; I set up a Behavioral Assessment Committee meeting for 4-17-90 as per the Code of Student Life and as per the suggestion of Dean Elsinga. I arranged for a new locker and mailbox for Vivian; I called in the specific student about whom Vivian had concerns and informed her that I did not want the two of them alone in any area and to take care not to be together without others present, at any time. I talked with the family physician that Vivian had last seen. I alerted the course directors to Vivian’s concerns.

4-17-90. The Behavioral Assessment was conducted. Attending were: Dr. John Vennes (representing the academic unit, UNDSM; Dr. Richard Grosz (UND Counseling Center); Harold Vanscoy (UND SHS); Duane Czapiewski (UND Police); Karl Snyter (UND Housing-Walsh Complex); and Judy DeMers and Marilyn Martin from UNDSM Student Affairs Office. Two recommendations were made: 1) Put a tracer on Vivian’s phone; 2) See Dr. Doan at SHS for psychiatric evaluation. Vivian was informed of the recommendations and an appointment was made with Dr. Doan.

REGULATIONS:

Appendix contains applicable regulations disregarded by the University of North Dakota.

PLEASE NOTE:

Apparently, DeMers decided to convene the behavioral assessment after my April 12, 1990, de facto dismissal but lacking justification concocted the prevarication about the telephone call.

JUDY DEMERS LIES AGAIN

FACTS:

Naturally, I wanted to know the content of the Behavioral Assessment Judy DeMers manipulated the University into convening without my presence. Therefore, I traveled to the Counseling center to obtain a copy of the report.

These recordings exhibit once again University Of North Dakota Associate Dean Judy DeMers is a liar.

Judy DeMers stated:

"I gave you a copy of minutes of the behavioral assessment you had not asked for one previously but did go to Student Counseling Center and demand one."

Counseling Center Employee: Hi

Me: Are you Estelle?

Counseling Center Employee: Yes I’m Estelle, hi.

Me: I don’t know if you remember me or not I came in here the other day I was looking for a copy of the behavioral assessment that was done Monday.

Counseling Center Employee: Right, Right

Me: OK, I was told by Judy DeMers I came in here and demanded a copy of it.

Counseling Center Employee: No. What I told her was that you had said the Dean of students had transferred you over here to get a copy of the records and that’s all I relayed of the information.

Me: I’ve been having some problems with her and I just wanted to check.

Counseling Center Employee: OK

Me: OK Thanks Have a good day

Counseling Center Employee: You too.
