Reality does not actually concur with Judy DeMers’ entry dated December 23, 1989. University records illustrate Judy DeMers does not refute my version of the disappearance of the embryology notes. Moreover, I knew about the Developmental Anatomy grade before telephoning Judy DeMers. Obviously, I could not borrow class notes until I returned to Grand Forks on the evening of November 27, 1990.

Additional Note: We identified the individuals involved in the theft and the other incidents of harassment but Judy DeMers’ refusals to comply with published regulations allowed these individual to go unpunished.

Nevertheless, Associate Dean Judy DeMers submitted the following half-truth to University committees and ultimately the Court to procure my medical school dismissal.



12-23-89. Vivian called me at home (Saturday). She was in Wyoming. She asked about the Embryology course and I informed her she had failed (70.0%). She began to insert that she should be allowed to repeat the first course exam due to her stolen notes. I told her that it was my recollection that she had noticed the notes missing on Wednesday, 11/22, just prior to Thanksgiving vacation. The exam was scheduled for 11/30; she was able to borrow notes from classmates; and she had not requested extra preparation time.

Citing sovereign immunity, the University of North Dakota refuses to comply with regulations guaranteeing me the opportunity to respond to this factually incorrect allegation!
