JUDY DEMERS’ FALSE STATEMENT DATED DECEMBER 12, 1989
Date incident allegedly occurred: December 12, 1989
Date of official medical school "dismissal": June 25, 1990
Date University first notified me of this charge: February 8, 1991
FACTS:
Medical and University records conclusively document the conversations to which Judy DeMers refers did not transpire. Nevertheless, Associate Dean Judy DeMers lied to University committees and ultimately the Court by creating and utilizing the following false statement to obtain my medical school dismissal.
JUDY DEMERS’ LIE
On 12-12-89, I again spoke with Vivian. I also spoke to Vivian’s therapist to let him know that "her anxiety level was very high and things seemed to be disintegrating." He informed me she had cancelled her 12-11-89 appointment with him, stating she was too busy. She called me at 8:00 p.m. at home, stating she was very stressed out. I told her of my great concerns about her need to see a professional about her extremely high level of anxiety. She resisted at first, but later agreed. She called back later to report she had contacted him and he was helpful.

Citing sovereign immunity, the University of North Dakota refuses to comply with regulations guaranteeing me the opportunity to respond to this factually incorrect allegation contrived months after my dismissal!
