JUDY DEMERSí FALSE STATEMENT DATED AUGUST 22, 1989

Date incident allegedly occurred: August 22, 1989

Date of official medical school "dismissal": June 25, 1990

Date University first notified me of this charge: February 8, 1991

FACTS:

University records verify I neither met with nor spoke to Judy DeMers on August 22, 1989. Moreover, Judyís discussion with Dr. Eicher was routine follow-up subsequent to my University return.

JUDY DEMERSí LIE

I met with Vivian Nelson several times early in the semester in an attempt to facilitate her smooth re-entry to medical school. The first meeting was on 8-17-89 for one hour. The next was for 30 minutes, by phone (she called) on the evening of 8-22-89. Whereas she was calm and fairly confident in the earlier meeting, she was very anxious and stressed throughout this conversation. Approximately 30 minutes after the conversation ended Vivian called again at 10:45 p.m. I obtained Vivianís permission to discuss her reaction to medical school with Dr. Robin Eickner.

EVIDENCE:

Accompanying chronological University record entries reveal DeMers concocted this prevarication long after dismissal.

PLEASE NOTE-During the early phase of the semester Judy & I did go out for dinner.

REGULATIONS:

Appendix contains applicable regulations disregarded by the University of North Dakota.

Citing sovereign immunity, the University of North Dakota refuses to comply with regulations guaranteeing me the opportunity to respond to this factually incorrect allegation contrived months after my dismissal!
