JUDY DEMERS’ FALSE STATEMENT DATED JANUARY 24, 1990

 

Date incident allegedly occurred: January 24, 1990

Date of official medical school "dismissal": June 25, 1990

Date University first notified me of this charge: February 8, 1991

 

FACTS:

University records verify Karl Snyter (University Housing Office) did not communicate with Judy DeMers regarding my fall. Judy DeMers’ allegation it is not logical. Why would Karl Snyter telephone Judy DeMers, a third party not involved in this matter? Logically, Karl Snyter would contact University Resident Hall Assistants Jennifer McDonald or myself. The University has no regulations for reporting injuries of this type. Nevertheless, I reported the fall to resident assistant Jennifer McDonald. (Note: a Malaysian student named Chea witnessed my fall.) Nevertheless, Associate Dean Judy DeMers lied to University committees and ultimately the Court by creating and utilizing the following false statement to obtain my medical school dismissal.

 

JUDY DEMERS’ LIE

1-24-90. Karl Snyter, Walsh Complex Director, called about the alleged incidence of her injuring her back by falling down the steps at Hancock Hall a week or so earlier. She had not reported the original incident to anyone. He questioned the validity of these reports.

Appendix contains applicable regulations disregarded by the University of North Dakota.

 

Citing sovereign immunity, the University of North Dakota refuses to comply with regulations guaranteeing me the opportunity to respond to this factually incorrect allegation contrived months after my dismissal!
