This document confirms the University of North Dakota School of Medicine abuses federally funded educational programs, engages in substantive due process and other regulatory violations including falsification of scholastic materials and forcing students to fail! Moreover, the University refuses to comply with regulations and correct these problems claiming sovereign immunity sanctions their abuses!

I attended the University of North Dakota School of Medicine as a full-paying customer from the State of Wyoming. (Wyoming does not have a medical school.) While attempting to study medicine at the University, I inadvertently learned Associate Dean Judy L. DeMers was utilizing her University position for political purposes outside the scope of her employment. Her activities included campaigning for and against various candidates and issues, soliciting and receiving contributions and political favors, organizing political events and conducting her own campaign. Subsequent to this discovery, Judy DeMers became very hostile towards me. She advised me several times she wanted me out of the University of North Dakota. Using her University position, DeMers was able to force me out of medical school! Her tactics included bombarding me with numerous false accusations (which greatly interfered with my studies), falsifying my student files and falsifying my academic grades. Her status as an Associate Dean gave her credibility in the eyes of many. Consequently, University staff members believed DeMers. Subsequently, I was unable to obtain answers to my academic questions and ultimately the committees deciding my future voted to force me to fail!

I tried repeatedly over the years to rectify this matter however University administrators refused to address the issues in this case, comply with published regulations or provide substantive due process promoting a lawsuit. Expressing approval for University abuses North Dakota invoked sovereign immunity thereby sanctioning regulatory disregard and revealing University regulations are meaningless! The University refused to address regulatory disregard, including harassment, medical confidentiality violations, lack of substantive due process, falsification of academic materials, insufficient security within the medical school and nonexistent regulatory enforcement. Unfortunately, it appears other University of North Dakota School of Medicine students suffered similar misadventures.

Upon acceptance into medical school, I expected an opportunity to obtain a quality education. I certainly did not expect harassment, abuse and dismissal because an Associate Dean cannot keep her personal political ideology out of her medical school office.

Influenced by DeMers, University committee members deliberating my future openly decided to force me to fail. I certainly would pass medical school if allowed to function as a student.
