Time Necessary To Travel To Appeal

Monty Nielsen, Chaired the University’s "appeal" committee, sent the University's "case" plus information regarding the location and time of the hearing via FedEx’s economy second day service to the wrong address on February 6, 1991!

We finally located this improperly addressed parcel in a distant city late in the afternoon of February 8, 1991, clearly to late travel to the appeal. Naturally, I requested the hearing be rescheduled or I be allowed to participate by telephone, but of course Monty Nielsen refused both requests!

Obviously, the University’s irresponsible handling of this material guaranteed I would not have time to travel to the hearing, review or respond to the plethora of new allegations advanced against me by Judy L. DeMers. The University of North Dakota intended to deny me due process.

*NOTE: I waited for the University's material to arrive because I simply did not trust these people. It was good I waited for their package-because they held the hearing in a different location than promised. Moreover, because they set the hearing for a weekend nobody could have told me the location of this "appeal."

8 February 1991

Note: I expected North Dakota to pull some type of stunt, nevertheless, I awoke at 6:30 a.m. prepared to depart immediately upon receipt of the University's material. Because of safety concerns, traveling past Douglas, WY was inadvisable.

Notes:

For safety I will not to drive alone late in the evening, especially in winter driving conditions.
Driving times presented in the table predicated on dry, non-slippery roads. Winter driving conditions require extra driving time.
Winter driving conditions existed during this period.
Safety breaks are five-minute rest periods from driving.
University held its "hearing" on February 9, 1991 at 1:00 PM. University administrators knew I could not travel 1007 miles in the time allotted, on icy roads then challenge a plethora of new allegations without preparation-obviously they intended to deny me due process.
Because of the lack of scheduled air service and inclement weather preventing the operation of small aircraft, flying was never an option.
